These terms govern your use of brandonrupert.com and any orders you place through it. By using the site or placing an order, you agree to them.

Who we are

Brandon Rupert is the trading name of the business operating this site. Registered address: 83 Crosby Street, Suite 3F, New York, NY 10012, USA. Customer support: support@brandonrupert.com.

Eligibility

To place an order on this site you must be at least 18 years of age (or the age of majority in your state) and have the legal capacity to enter into binding contracts. If you are ordering on behalf of a business or organisation, you confirm you are authorised to bind that entity to these terms.

Account use

If you create a customer account, you are responsible for keeping your login credentials secure. You must notify us at support@brandonrupert.com if you suspect unauthorised access to your account. We are not responsible for losses arising from credentials that have been shared, stolen, or guessed because of weak passwords.

Orders and contracts

Placing an order is an offer to buy. We accept that offer when we send you a dispatch confirmation email — that is the point a binding contract is formed.
We may decline an order at our discretion (stock unavailable, pricing error, suspected fraud, address we can't ship to, or any other reasonable basis). If we decline, we refund any payment in full within 5 business days.
All prices are displayed in US dollars (USD). Sales tax, if applicable to your delivery state, is calculated and shown at checkout.

Pricing and availability

We try to keep prices, descriptions, and availability accurate, but errors happen. If we discover a pricing error after you've placed an order, we'll contact you and offer either the corrected price or a full refund.
Each piece is made in small runs of full-grain calfskin. Once a colourway is sold out, it may not return.
We reserve the right to limit order quantities or refuse orders that we reasonably believe are for resale.

Payment

Payment is taken in full at checkout. We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, and Shop Pay through Shopify Payments. We do not store full payment card details on our servers; all card processing is handled by PCI-DSS compliant providers.

If your payment is declined, your order is cancelled. We cannot process partial payments or layaway arrangements.

Delivery and returns

See our Shipping Policy and Returns & Refunds Policy for full details. Delivery dates given at checkout are estimates and not guarantees; we are not liable for losses arising from delays outside our reasonable control.

Faulty or incorrect items

If your order arrives faulty or isn't what you ordered, email us within 14 days at support@brandonrupert.com with a photograph and your order number. You're entitled to a refund or replacement at your choice. This is in addition to any rights you have under your state's consumer protection laws.

Product descriptions and warranties

We work to ensure all product descriptions, material details, dimensions, and imagery are accurate. Variations in monitor calibration, natural leather grain, and small-batch dyeing may cause minor differences between the product as shown and as delivered. These are not defects.

Beyond our published returns policy and any non-disclaimable rights granted to you by your state's consumer protection laws, all products are supplied "as is" without any further warranty, express or implied.

Intellectual property

All text, images, illustrations, logos, photography, design elements, and source code on this site belong to Brandon Rupert or are licensed to us. You may not reproduce, redistribute, modify, transmit, or use them commercially without our prior written permission. Personal browsing and order use is fine.

The Brandon Rupert name and any associated logos or marks are trademarks of the business. Use of these marks without our written permission is prohibited.

Acceptable use

You agree not to:

Use the site for any fraudulent or illegal purpose.
Interfere with the security, integrity, or availability of the site.
Scrape, crawl, or harvest data from the site at scale or by automated means.
Reverse engineer or attempt to extract source code or design from the site.
Use the site to transmit viruses, malware, or other harmful code.
Impersonate any person or misrepresent your affiliation with any entity.

We may suspend access, cancel orders, or pursue legal action against any user who breaches these conditions.

Third-party links and services

Our site may contain links to third-party websites or use third-party services (payment processors, shipping carriers, analytics providers). We are not responsible for the content, terms, or practices of those third parties. Your interactions with them are governed by their own terms and policies.

Liability

To the maximum extent permitted by applicable law, our liability to you for any loss arising from your use of the site or a faulty product is limited to the price you paid for the goods in question. This limit does not apply where the law prevents such limitation (including death, personal injury caused by our negligence, fraud, or breach of statutory consumer protection rights).

We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.

Indemnification

You agree to indemnify and hold Brandon Rupert, its officers, employees, and agents harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these terms, your misuse of the site, or your violation of any applicable law.

Force majeure

We are not liable for any failure or delay in our performance caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, war, terrorism, civil unrest, government action, pandemics, carrier disruption, or supply chain failures.

Governing law and disputes

These Terms are governed by the laws of the State of New York, United States of America, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or your use of the site shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

Nothing in these Terms removes the consumer protection rights you have under the law of the US state where you live.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, constitute the entire agreement between you and Brandon Rupert regarding your use of the site, and supersede all prior agreements and understandings.

Changes

We may update these Terms from time to time. The version in force is the one shown on this page at the time of your order. Continued use of the site after changes constitutes acceptance.
